Privacy Policy and personal data processing

What we collect through this site, why, how long we keep it, who receives it and your rights over it.

This policy explains what personal data My Ecuador Real Estate ("we") collects through myecuadorrealestate.com, why we collect it, on what legal basis, how long we keep it, who receives it and how you can exercise your rights. It follows Ecuador's Organic Law on Personal Data Protection (Ley Orgánica de Protección de Datos Personales, LOPDP) and is also written for visitors from the United States.

1. Who is responsible for your data

2. What we collect, why, and on what legal basis

  • Contact form. Name, email, phone with country code (optional), whether you want to build, buy a ready home or are not sure yet, and your message. We use it to answer you and to prepare options for you. Legal basis: your consent, given by ticking the box next to the form, and, if you ask for a proposal, the steps needed before a possible contract. We also record which version of this policy you accepted and when, as proof of your consent.
  • Email and calls. What you write to us or tell us on a call, for the same purposes and with the same legal basis. Booking a call: [PENDIENTE: herramienta para agendar llamadas, por ejemplo Calendly, y qué datos recoge].
  • WhatsApp. If you write to us on WhatsApp, WhatsApp (Meta) processes your number and messages under its own terms, and we use them to answer you. Our WhatsApp number is +593 99 849 4447.
  • Technical and security data. IP address, browser, pages visited, date and time, recorded in server logs; and spam protection on forms (a hidden field, a limit on messages per connection, and reCAPTCHA). We keep the connection used for the limit only as an irreversible code for one hour. Legal basis: our legitimate interest in keeping the site secure and free of abuse.
  • Analytics, only if you accept. Pages visited, approximate region, device type and how you arrived, to see which pages help visitors. Legal basis: your consent, which you can withdraw at any time. [PENDIENTE: confirmar que se usa Google Analytics 4 y con qué configuración]
  • If you decide to buy or build with us. We will need further data, such as identity and tax documents, to carry out the legal purchase and the contract. 3. What we do not do

We do not sell your data. We do not send marketing emails unless you ask for them separately, with a box of its own that is never ticked in advance. We do not use your data for automated decisions or profiling that affects you. The site is not directed to people under 18 and we do not knowingly collect their data.

4. Cookies and similar technologies

The site needs no cookies to work. When you answer the cookie notice, your choice is saved in your own browser (local storage) so that we do not ask again; it is not sent to us.

  • Spam protection (reCAPTCHA, Google). It loads only when you start filling in a form, not when you open a page. It may read information about your device and set cookies; Google handles that under its own Privacy Policy.
  • Analytics. Off until you press "Accept analytics". If you press "Reject", it stays off. You can change your choice at any time with "Cookie settings" in the footer of every page.

5. Who receives your data

Only what is needed, and never for advertising:

  • Service providers that work for us: web hosting [PENDIENTE: proveedor de hosting], email [PENDIENTE: proveedor de correo], site security and delivery [PENDIENTE: Cloudflare, si se usa], and Google (reCAPTCHA; analytics only if you accept).
  • People involved in your project, when you ask us to go ahead with a purchase or a build: licensed attorneys, notaries, builders and partners such as VilcaBuild in Vilcabamba. They receive only the data they need, and you will know who they are.
  • Authorities, when the law requires it.

6. Transfers outside Ecuador

We are based in Ecuador. Some providers, such as Google, may process data in other countries, including the United States. We choose providers that offer the safeguards the LOPDP requires for international transfers. [PENDIENTE: países y garantías de cada proveedor, a confirmar con el abogado]

7. How long we keep your data

  • Messages and contact details: while we are in conversation and for up to [PENDIENTE: plazo, por ejemplo 24 meses] after the last contact. After that they are deleted; the site does this automatically for contact form messages.
  • If you become a client: the time that tax, accounting and contract law require.

8. Your rights and how to use them

Under the LOPDP you have the right to be informed, to access your data, to rectify and update it, to delete it, to object to its processing, to ask us to suspend it, to receive it in a portable format, and not to be subject to decisions based only on automated processing. You can withdraw your consent at any time, and doing so does not affect what we did before.

To use any of these rights, write to info@myecuadorrealestate.com saying what you want and from which email address you wrote to us. We may ask you to confirm your identity. It is free, and we answer within the legal deadline of [PENDIENTE: plazo en días, a confirmar por el abogado]. If you think we have not handled your data properly, you can file a complaint with Ecuador's data protection authority (Superintendencia de Protección de Datos Personales).

Visitors from the United States. You can use the rights above wherever you are. You may also ask what personal data we hold about you and ask us to correct or delete it. We do not sell personal data or share it for advertising.

9. Security and incidents

The site is served over HTTPS. Messages from the contact form are stored privately in the site's administration, with access limited to the people who need them to answer you. If a security incident affects your data, we will notify the data protection authority and the people affected as the law requires.

This site may link to other sites, such as Google or WhatsApp. They have their own privacy policies and we are not responsible for them.

11. Changes to this policy

When this policy changes we will update the version and date above and, if the change is important and we are in contact, we will tell you by email. You can ask us for earlier versions.
